12.04.20 | Brexit Withdrawal Agreement Explained

The declaration on the future relationship between the European Union and the United Kingdom, also known as the Political Declaration, is a non-binding declaration, negotiated and signed at the same time as the mandatory and broader withdrawal agreement on the uk`s withdrawal from the European Union (EU), known as Brexit, and the planned end of the transition period. The 2019 revisions also adapted elements of the political declaration and replaced the word “appropriate” with “appropriate” with respect to labour standards. According to Sam Lowe, a trade fellow at the Centre for European Reform, the amendment excludes labour standards from dispute resolution mechanisms. [27] In addition, the Equal Competition Mechanism has been postponed from the legally binding withdrawal agreement to the political declaration,[24] and the line of the political statement that “the United Kingdom will consider taking into account alignment with trade union rules in the relevant areas” has been removed. [26] The UK`s official withdrawal from the EU came into force on 31 January 2020 at 11 p.m. (withdrawal day). On that date, the withdrawal period under Article 50 of the TUE ended and the ratified withdrawal agreement, which sets out the legal conditions for the UK`s withdrawal, came into force. The ratified withdrawal agreement was published in the Official Journal of the European Union on the day of the withdrawal, as well as the political statement on the framework of the future relationship between the UK and the EU: the withdrawal agreement also governs the UK`s contributions to the EU budget. The agreement implies that the UK, as a member, will pay the entire long-term budget until the end of 2020. The withdrawal agreement between the European Union and the United Kingdom sets out the conditions for the UK`s orderly exit from the EU, in accordance with Article 50 of the Treaty on european Union.

The withdrawal agreement provided for an extension of the transition period to avoid the “non-deal” of Brexit if no agreement between the EU and the UK could be reached by 31 December 2020. Such an extension should have been requested until July 2020. Following a statement by Prime Minister Boris Johnson that he would not use this option and that 11 months would be enough to reach a comprehensive agreement, the British government added a provision to the 2020 Law to prohibit a British minister who wants such an extension, and no extension was sought. Since January, the UK has been able to negotiate its future trade relationships with other countries around the world. If the negotiations are not successful, there will be a Brexit without a deal. This view provides a guide to the withdrawal agreement and the expiry of the transition period. The Northern Ireland Protocol, known as the Irish Backstop, was an annex to the November 2018 draft agreement outlining provisions to avoid a hard border in Ireland after the UK`s withdrawal from the European Union. The protocol provided for a provision of the safety net to deal with the circumstances in which satisfactory alternative arrangements were to come into force at the end of the transition period.
