Brian practices intellectual-property litigation and focuses on patent litigation. He has experience in all stages of litigation: pre-suit diligence including opinion work, fact and expert discovery including non-dispositive motion practice, preliminary injunctions, claim construction, damages, summary judgment, trials, and appeals. He also has experience in litigation-related proceedings before the U.S. Patent and Trademark Office, including before both the Patent Trial & Appeal Board and the Trademark Trial & Appeal Board. He also has experience in alternative dispute resolution.

In addition to litigation, Brian has experience in intellectual-property diligence matters on behalf of clients investing in technology-focused businesses. Brian also advises small start-up clients on IP-related legal matters, including assignments, licenses, and IP procurement. He also has experience handling First Amendment issues for both individual and institutional clients.

Brian has experience across a wide spectrum of technical disciplines, including mechanical, electrical, computer, software, chemical, pharmaceutical, and medical-device technologies. And he has worked for clients across a similarly wide spectrum of industries, both big and small.

Brian graduated with honors from Northwestern University with a degree in chemistry, specializing in organic synthesis and catalysis. He graduated magna cum laude from the University of Michigan Law School, where he was an Executive Editor of the Michigan Law Review. Before law school, Brian served as an officer in the U.S. Navy, specializing in the operation, maintenance, and repair of shipboard propulsion, electrical, and nuclear systems. Prior to joining Banner & Witcoff, Brian clerked for Chief U.S. District Judge John R. Tunheim at the U.S. District Court for the District of Minnesota.

Brian is admitted to practice in the State of Minnesota. Practice in Illinois is limited to matters and proceedings before federal courts and agencies.
