PRODUCT CONFIGURATION TRADE DRESS

This session will look at recent case law, including the Converse ITC case involving footwear, the Apple v. Samsung case, and consider how to best protect and defend product configuration under the trademark laws, and whether to strategically combine trade dress with design rights in an enforcement proceeding. The session will also address issues of infringement and validity, including, functionality.
